Roboqbo Srl (“Roboqbo”), with registered office at Via Mazzini 1, 40010 Bentivoglio (BO), Italy, as the data controller of personal data (the “Data Controller”), hereby informs you of the following and asks you to carefully read the contents of this Privacy Notice.

This Privacy Notice is provided to Roboqbo customers, as the website www.roboqbo.com (hereinafter the “Website”) may collect personal data relating to you, as specified below. In any case, the provisions contained in the privacy notice provided by Roboqbo to its customers upon conclusion of the contract, concerning the processing of their personal data for the purposes of performing the contract, shall remain unaffected.

a) Purposes and legal bases for processing

Roboqbo may collect your personal data if you provide it in order to register for and access the restricted area which, among other things, allows you to extend the warranty of the machine, access technical documentation and submit requests, or to use the e-commerce platform.

In addition to providing you with the requested service (both access to the restricted area and use of the e-commerce platform), Roboqbo may process your personal data, with your specific consent, manually or by electronic means, for the purpose of sending you commercial communications, newsletters, updates or invitations to events.

Your email address, provided in connection with the sale of a product or service, may also be used to send you commercial communications concerning products or services similar to those covered by the sale, unless you have objected to such processing. Roboqbo informs you that you may object to such processing at any time, easily and free of charge.

Furthermore, following your request to participate, your personal data may also be processed for the purposes of organising the Data Controller’s events and enabling you to participate in them. For example, Roboqbo may send you communications confirming your registration or sharing event details.

Finally, the Website also collects data through cookies and similar technologies. For further information, please refer to our Cookie Policy.

b) Mandatory or optional nature of providing personal data and consequences of failure to provide such data

Providing your personal data for the purpose of performing the contract (use of the requested service) and managing your participation in events is optional. However, failure to provide such data may make it impossible to provide the requested services.

Providing your data for direct marketing purposes is optional and requires your prior consent. In the absence of such consent, you may still use the requested service, although Roboqbo will not be able to send you promotional communications concerning its products and services.

c) Retention period of personal data

Your personal data will be retained only for the period strictly necessary for the purposes set out in section a) above and, in any event, for no longer than ten years from the termination of the contractual relationship, after which it will be deleted or anonymised.

This is without prejudice to any requirements relating to ongoing or threatened legal proceedings.

d) Recipients or categories of recipients of personal data and transfers to countries outside the European Economic Area

Your data may be shared with the following recipients:

• entities, organisations or authorities to which disclosure is mandatory pursuant to laws or regulations;
• individuals, companies or professional firms which, acting as external data processors or independent data controllers, provide the Data Controller with assistance and consultancy services relating to the maintenance and development of Roboqbo’s IT systems, IT and telecommunications or archiving services, or accounting, administrative, legal, tax, financial and debt recovery services in connection with the provision of the service;
• authorised internal personnel.

Your personal data will not be disclosed or disseminated, unless this is necessary to comply with obligations established by laws or regulations and/or to fulfil obligations arising from the contractual relationship.

To the extent strictly necessary for the purposes set out in section a), your data may be transferred to recipients established in countries outside the European Economic Area that provide the Data Controller with services connected with the relevant processing activities.

Where applicable, such transfers will take place solely in compliance with the conditions established by the GDPR. Whenever personal data is transferred to countries that do not benefit from an adequacy decision by the European Commission, the transfer will take place exclusively:

(i) following the execution of the standard contractual clauses adopted by the European Commission and the adoption of any additional technical, organisational and/or contractual measures appropriate to ensure a level of protection of personal data that is adequate and, in any event, essentially equivalent to the level of protection guaranteed within the EEA; or

(ii) where one of the derogations provided for under Article 49 of the GDPR applies.

A copy of the appropriate or suitable safeguards adopted is available at the Data Controller’s registered office and may be requested at any time.

e) Rights of data subjects

You may exercise the following rights at any time:

a) the right to access your personal data;

b) the right to rectify or erase your personal data;

c) the right to restrict the processing of your personal data;

d) the right to object, at any time and on grounds relating to your particular situation, to the processing of personal data concerning you where such processing is carried out in pursuit of the Data Controller’s legitimate interests, unless the Data Controller demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing is necessary for the establishment, exercise or defence of legal claims;

e) the right to object, at any time, to the processing of personal data concerning you for direct marketing purposes;

f) the right to object, at any time and free of charge, to the processing of personal data for the purpose of offering products or services similar to those purchased;

g) the right to data portability;

h) the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent given prior to its withdrawal.
